PLAINTIFF'S REPORT ON MEETING FOR JOINT PRETRIAL STATEMENT

The undersigned attorney makes the following report to the Court concerning the meeting for the joint pretrial statement:

1. There was no appearance at the time and place specified for the meeting by any attorney representing the Defendants other than a brief telephone call with Roy Lucas, Esq. Mr. Lucas had sent a letter suggesting a change in the meeting place which was received late last night by the undersigned.

2. The undersigned attempted to advise Mr. Lucas this morning that since the District Judge's Order had not been modified, the undersigned would be in Melbourne at the specified meeting place.

3. The meeting place was the Torpy law office which has been used for all meetings since Mr. Torpy's withdrawal.

4. Mr. Lucas refused to confer over the telephone when requested by the undersigned to go forward with the conference. He hung up the telephone. Thereafter the undersigned and the court reporter adjourned the meeting.

WHEREFORE, the plaintiff files this report and requests the District Judge to take whatever action in this case that is appropriate.
