Re: William Phillip Egherman, M.D., Case No. 97-08261

Dear Mr. Raney:

Please be advised that the complaint which you filed against Dr. Egherman in the matter referenced above has been investigated and the findings reviewed by the Probable Cause Panel of the Board of Medicine. Pursuant to Section 455.621(2), Florida Statutes, the Department of Health, by and through the Agency for Health Care Administration, pursuant to the provisions of Section 20.43(3), Florida Statutes, found that there was insufficient evidence to support the prosecution of the allegation that a violation of Chapter 458, Florida Statutes, or the rules promulgated thereunder, had occurred. Therefore, the Department directed that the case be dismissed.

The Department based its decision on a review of the investigative report, the documents submitted and the opinion of the Department’s Consultant. The Consultant found that Dr. Egherman did not breach the standard of care. Perforation of the uterus is a known and common complication of an abortion. Dr. Egherman acted timely and properly when he realized that the perforation might have occurred. (Emphasis added.)

The provisions of Section 455.621(9)(c), Florida Statutes, apply to this case. That Section states, “In any disciplinary case for which probable cause is not found, the department shall so inform the person who filed the complaint and notify that person that he or she may, within 60 days, provide any additional information to the probable cause panel which may be relevant to the decision.” You will have sixty (60) days from the date of this letter to submit any materials, in writing, to the department at the address listed below.
